Public Notice - Development Variance Permit No. 562

Pursuant to Section 499 of the Local Government Act, public notice is hereby given that Council for the City of Fernie will consider the issuance of Development Variance Permit No. DVP-562 at a Regular Meeting of Council on TUESDAY, SEPTEMBER 26TH, 2023, at 6:00 PM at the Senior Citizens Drop In Centre located at 562 – 3rd Avenue, Fernie, BC.

Location: 991 7th Avenue

Legal Description: Lot 10 Block 80 District Lot 4588 Kootenay District Plan 734A

Purpose: The proposed variance will allow for the conversion of the existing commercial building into a dwelling unit on the subject lot by varying Zoning Bylaw No. 1750 as follows:

  1. Waive Section 4.2.13.5.3.i) to not require the dwelling unit to be design and constructed as part of the principal building; and,
  2. Waive Section 4.2.13.5.3.iv) to not require the dwelling unit to be located above the first storey of the building or behind the commercial component of the building, with the exception of motels and hotels, where the residential units may be on the main floor.

Public participation will be accepted through written submission and must be submitted before 2:00 PM the day of Council Meeting where the DVP will be considered by any of the following formats:
